Different states may use different forms, letters, notices, titles, etc., but their practices, techniques and procedures are similar to the IRS. The IRS and states all use monthly installment agreements, Offers in Compromise, liens, levies, summons, etc. Tax collectors use administrative or statutory law to collect taxes. Therefore, they rarely, if ever, have to go to court to implement enforcement tools. Bottom line: tax collectors, federal and state, use many of the same concepts. For example:

  1. Deadline dates are vitally important because a common trait of most tax debtors is procrastination. It is the responsibility of tax collectors to resolve a case in an expeditious manner and they all have managers to insure that they set specific deadline dates for specific actions by taxpayers. If you do not meet the deadlines the tax collector uses enforcement tools such as levies on wages, banks, accounts receivable and retirement accounts, tax liens, summonses, "keepers" in businesses, etc., to insure that taxpayers take expeditious action to resolve the problem.
  2. Tax collectors obtain and analyze financial information to determine a taxpayer's "ability to pay."
  3. Tax collectors typically first look for equity in property. They expect tax debtors to borrow on that equity to pay taxes. They may require that assets not necessary for the health and welfare of the family or necessary for the production of income to be sold and the proceeds paid toward the tax liability.
  4. The tax collector will obtain and analyze the taxpayer's monthly income versus monthly "necessary and allowable" living expenses in order to determine if there is monthly disposable income to enter into a monthly installment agreement. The important issue here is the tax agency's determination as to what is "necessary and allowable" as opposed to what is not necessary or excessive.
  5. Most all actions and enforcement by tax collectors can be appealed to their managers and their manager's manager. Some tax agencies have a formal appeals process if a tax collector/manager is abusive or does not follow specific procedures properly. The key is to know what those procedures may be.
